3. Disclaimer of Warranties

ABC Tester and all associated tools, content, and services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties of accuracy: We do not guarantee that test results will be 100% accurate in all scenarios
  • Warranties of availability: We do not guarantee uninterrupted, secure, or error-free operation
  • Warranties of compatibility: We do not guarantee functionality with all browsers, devices, or configurations

Test results should be used as general guidance and reference points, not as absolute measurements. For critical applications, competitive rankings, or professional equipment evaluation, we recommend using specialized professional-grade testing equipment.

4. Limitation of Liability

To the maximum extent permitted by applicable law, ABC Tester, its operators, affiliates, partners, and contributors shall not be liable for any:

  • Direct, indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, business opportunities, or goodwill
  • Hardware damage, malfunction, or wear caused by testing activities
  • Personal injury or property damage resulting from your use of the service
  • Unauthorized access to or alteration of your data or transmissions
  • Decisions made or actions taken based on test results or information from our tools
  • Any third-party conduct, content, or services accessible through our platform

Our total aggregate liability for any claims arising from your use of ABC Tester shall not exceed zero dollars ($0.00 USD), as the service is provided free of charge.

You use ABC Tester entirely at your own risk. This limitation applies regardless of the legal theory (contract, tort, strict liability, or otherwise).

5. Accuracy of Test Results

While we strive for accuracy and use industry-standard methodologies, test results may vary based on numerous factors, including:

  • Browser limitations: Different browsers have varying levels of precision and timing capabilities
  • Hardware configuration: Your CPU, GPU, RAM, and other components affect performance
  • Operating system: Windows, macOS, Linux, and mobile OS may produce different results
  • Background processes: Other applications running on your system can impact measurements
  • Network conditions: For tests involving server communication, internet speed and latency matter
  • Power settings: Battery saver modes and power management can throttle performance
  • Display settings: Monitor refresh rate and V-Sync settings affect visual tests

For the most consistent results, we recommend closing unnecessary applications, using a modern browser (Chrome, Firefox, Edge), and running tests multiple times to establish an average.

6. Intellectual Property

All content, code, design elements, logos, graphics, text, and other materials on ABC Tester are protected by copyright, trademark, and other intellectual property laws.

The ABC Tester name, logo, and branding are trademarks of ABC Tester. You may not use these marks without prior written permission.

10. Governing Law & Disputes

These Terms of Service shall be governed by and construed in accordance with applicable international laws, without regard to conflicts of law principles.

You agree that any cause of action arising from your use of ABC Tester must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action is permanently barred.
